Terms of Service

Plain English, because an agreement nobody can read is not an agreement. This is between us and the business using Isle Order.
Who this agreement is between
Isle Order is operated by TAPP Digital Incorporated in Barbados. This agreement is between us and the business using the service — the shop, restaurant or maker whose storefront runs on Isle Order. Throughout, "you" means that business.
Your customers are not party to this agreement. Their relationship is with you: you sell to them, you take their money, and you are responsible for what you sell them. We provide the software you do it with.
What it costs
Isle Order is a paid service, charged as a subscription. You choose monthly or yearly when you sign up, and the price you were quoted is the price on your invoice. There is no commission on your sales and no fee per order.
Setting your shop up for you — loading your products, hours, payment details and QR codes — is a separate one-off fee, quoted before we start and only charged if you ask for it. You can always do it yourself instead, at no cost.
We do not store your card and nothing charges automatically. We send an invoice before each period and you pay it the way you chose. If that changes and we introduce automatic payment, it will be something you opt into rather than something that begins on its own.
Some businesses are on agreed free or reduced terms, including our founding partners. If that is you we have told you so in writing, and it stands until we agree something different with you.
Paying, and not paying
A subscription is paid in advance for the period ahead. A setup fee is payable once the work is done.
If an invoice goes unpaid we will contact you, more than once, before anything happens to your shop. If it stays unpaid we may pause your storefront, which stops your customers placing orders. We will tell you before we do that, not after.
A paused shop is not a deleted one. We keep your products, orders and customer list for at least ninety days, and a single payment puts you back exactly where you were.
Subscriptions are not refunded for part of a period. You can cancel at any time and your shop keeps running until the period you have paid for ends. A setup fee is not refundable once the work has been done, because it has been.
Price changes
We may change what Isle Order costs. If we do, we will tell you at least thirty days before it affects you, and the change never applies to a period you have already paid for.
If a new price is not one you want to pay, cancel before it takes effect and nothing further is charged.
The service is still young
Isle Order is actively built on. We may add, alter or remove features, and we will tell you when something affects the way you work. Where a change takes something away that you were relying on, we will say so plainly rather than let you discover it.
Your account
You are responsible for who you give access to. Everyone should have their own login rather than sharing one — you can see who did what, and somebody leaving does not mean changing the password for everybody.
Tell us promptly if you believe an account has been compromised.
Payments between you and your customers
Isle Order does not process payments and never touches your money. When a customer places an order we record it and tell them how you have said you want to be paid. Every order arrives marked unpaid until you confirm you have received the money.
That means we cannot see, hold, refund or dispute a payment. Any question about money for an order is between you and your customer.
What you are responsible for
What you sell, what you say about it, and whether you are allowed to sell it. That includes any licence you need — alcohol and food handling in particular — and the accuracy of your prices, allergen information and opening hours.
Handling your customers fairly, including refunds, cancellations and anything that goes wrong with an order.
The content you upload. You keep ownership of your logo, photos and words; you give us permission to store and display them for the purpose of running your storefront.
What we are responsible for
Running the service with reasonable care, keeping your data backed up, and telling you honestly when something has gone wrong.
We do not promise the service is never unavailable. It runs on infrastructure we do not own, and we do not offer an uptime guarantee or service credits. What we do promise is that we will not hide an outage from you.
Your data is yours. Ask and we will export it. If you leave, we will give you your products, orders and customer list in a usable format.
Ending it
You can stop using Isle Order whenever you like and ask us to close your account. We will export your data for you first if you want it.
We may suspend or close an account that is being used for something illegal, that is harming other businesses on the platform, or where we are required to. Except where something is seriously wrong, we will tell you first and give you a chance to put it right.
Limits
If we are liable to you for anything arising out of this agreement, that liability is limited in total to what you have paid us in the twelve months before it happened. If you have paid us nothing, it is limited accordingly.
We are not liable for lost profits or lost sales. We are not liable for a customer who does not pay you, an order that goes wrong, or anything you sell.
Nothing here removes a right you have under Barbados law that cannot be signed away, and nothing here limits our liability for fraud or for death or personal injury caused by our negligence.
